referred to the Committee on the Judiciary

A BILL
To increase penalties for certain violations of the H-1B nonimmigrant
visa program, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``H-1B Visa Fraud Crackdown Act''.
SEC. 2. INCREASED PENALTIES FOR SERIOUS H-1B VIOLATIONS.
Section 212(n)(2)(C) of the Immigration and Nationality Act (8
U.S.C. 1182(n)(2)(C)) is amended--
(1) in clause (ii)--
(A) in subclause (I), by striking ``$5,000'' and
inserting ``$100,000''; and
(B) in subclause (II), by striking ``at least 2
years'' and inserting ``at least 5 years''; and
(2) in clause (iii)--
(A) in subclause (I), by striking ``$35,000'' and
inserting ``$250,000''; and
(B) in subclause (II), by striking ``at least 3
years'' and inserting ``at least 10 years''.
SEC. 3. PENALTIES FOR DOCUMENT FRAUD.
Section 274C(d)(3) of the Immigration and Nationality Act (8 U.S.C.
1324c(d)(3)) is amended--
(1) in subparagraph (A), by striking ``not less than $250
and not more than $2,000'' and inserting ``not less than $1,000
and not more than $10,000''; and
(2) in subparagraph (B), by striking ``not less than $2,000
and not more than $5,000'' and inserting ``not less than
$20,000 and not more than $50,000''.
