R. 10718 To establish a temporary process for former Federal employees to obtain personnel records, secure administrative corrections to personnel and benefits documentation, and receive benefits coordination support, and for other purposes. _______________________________________________________________________ IN THE HOUSE OF REPRESENTATIVES October 1, 2026 Mr. Walkinshaw (for himself, Ms. Norton, Mr. Beyer, Mr. Hoyer, Ms. Tlaib, Mr. Lynch, Mr. Ivey, and Mr. Subramanyam) introduced the following bill; which was referred to the Committee on Oversight and Government Reform _______________________________________________________________________ A BILL To establish a temporary process for former Federal employees to obtain personnel records, secure administrative corrections to personnel and benefits documentation, and receive benefits coordination support, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``Federal Employee Records Relief Act''. SEC. 2. REQUESTS FOR FEDERAL EMPLOYEE PERSONNEL RECORDS, SECURE ADMINISTRATIVE CORRECTIONS TO PERSONNEL AND BENEFITS DOCUMENTATION, AND RECEIVE BENEFITS COORDINATION SUPPORT. (a) Required Actions.--A covered individual may submit to the Director of the Office of Personnel Management a request for administrative correction of a covered personnel record error and for access to personnel records. Upon request by a covered individual-- (1) the Director, in coordination with the individual's last employing entity, shall provide the covered individual copies of relevant personnel records, including separation- related personnel actions (including SF-50s); (2) the Director and the last employing agency shall take such actions as are necessary, within their respective authorities, to complete administrative correction of a covered personnel record error, including by issuing missing personnel actions or corrected personnel actions; or (3) the Director shall provide written information and coordination assistance regarding benefits enrollment status and coverage end dates, and available continuation options, including temporary continuation of coverage under section 8905a of title 5, United States Code. (b) Administration.-- (1) In general.--The Director shall carry out this Act through the Retirement Services Office of the Office (or any successor office), or such other component of the Office as the Director may designate. (2) Cooperation.--Each entity of the Federal Government shall, upon request of the Director, search for and furnish to the Director records and information necessary to carry out this Act in a timely manner consistent with applicable law governing personnel records and reporting requirements. (3) Application.-- (A) Administrative relief only.--Assistance and corrections under this Act are limited to administrative completion, correction, reissuance, certification, and provision of records and benefits coordination information. (B) No recharacterization requirement.--Nothing in this Act shall be construed to require an entity of the Federal Government to change the characterization of a separation (including resignation, retirement, or removal) absent a final order, settlement, or other binding legal determination under otherwise applicable law. (C) Sunset.--A request under subsection (a) by a covered individual shall be submitted during the 4-year period beginning on the date of the enactment of this Act, and any request submitted after the end of such period shall not be accepted or processed under this Act. (D) Annuitants.--A covered individual may submit a request under this Act regardless of whether such individual is a Federal annuitant. (c) Definitions.--In this Act-- (1) the term ``covered individual'' means an individual who-- (A) was employed by an entity of the Federal Government (but not including the uniformed services as that term is defined in section 101 of title 10, United States Code); and (B) separated from Federal employment for any reason on or after January…

20, 2025; (2) the term ``covered personnel record error'' means a missing, incomplete, or erroneous personnel record or personnel action that affects, relates to, or is needed to document-- (A) the individual's separation, position, pay, or leave status (including leave liquidation); or (B) enrollment, termination dates, eligibility, or election processing under a Federal employee benefits program (including health benefits continuation options); (3) the term ``Director'' means the Director of the Office of Personnel Management; and (4) the term ``personnel records'' includes the Official Personnel Folder and related records and personnel actions for current and former employees. <all>
