A BILL
To amend the Magnuson-Stevens Fishery Conservation and Management Act
to provide for the regulation of fishing in marine national monuments.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. REGULATION OF FISHING IN MARINE NATIONAL MONUMENTS.
Section 304 of the Magnuson-Stevens Fishery Conservation and
Management Act (16 U.S.C. 1854) is amended by adding at the end the
following:
``(j) Regulation of Fishing in Marine National Monuments.--
``(1) Prohibition on regulation by presidential
proclamation.--Fishing in a marine national monument shall not
be prohibited or otherwise regulated through a Presidential
proclamation under section 320301 of title 54, United States
Code (commonly known as the `Antiquities Act of 1906'),
including any existing such Presidential proclamation.
``(2) Continued regulation under this act.--Fishing in a
marine national monument shall continue to be regulated
pursuant to this Act, consistent with other applicable law.''.
