A BILL
To establish the Department of Advanced Technology and Artificial
Intelligence, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Department of Advanced Technology
and Artificial Intelligence Act''.
SEC. 2. DEPARTMENT OF ADVANCED TECHNOLOGY AND ARTIFICIAL INTELLIGENCE.
(a) In General.--There is established a Department of Advanced
Technology and Artificial Intelligence (in this section referred to as
the ``Department''), as an Executive department of the United States
within the meaning of title 5, United States Code.
(b) Secretary.--
(1) In general.--There is a Secretary of Advanced
Technology and Artificial Intelligence appointed by the
President, by and with the advice and consent of the Senate.
(2) Head of department.--The Secretary of Advanced
Technology and Artificial Intelligence is the head of the
Department and shall have direction, authority, and control
over it.
(3) Functions vested in secretary.--All functions of all
officers, employees, and organizational units of the Department
are vested in the Secretary.
(c) Mission.--The primary mission of the Department is to carry out
the following:
(1) Develop a Federal technology and artificial
intelligence framework to update relevant Federal statutes.
(2) Develop a Federal strategy across all Federal
departments and agencies to ensure such departments and
agencies are in a consistent manner developing and implementing
standards and policies relating to the utilization of
artificial intelligence by such departments and agencies.
(d) Functions.--To carry out the mission of the Department under
subsection (c), the Secretary shall carry out the following:
(1) Fund and carry out research and infrastructure
management related to the utilization of artificial
intelligence by Federal departments and agencies, as determined
by the Secretary.
(2) Develop standards for safety and oversight guidance
with respect to such utilization.
(3) Establish artificial intelligence incident reporting
systems for cybersecurity risks and breach prevention related
to such utilization.
(4) Develop regulatory frameworks for the Department to
promulgate regulations related to such utilization.
(5) Provide a strategies related to the following:
(A) How to promote the following:
(i) Literacy related to artificial
intelligence in schools.
(ii) Workforce programs related to
artificial intelligence utilization.
(B) How to address labor displacement to coordinate
worker protections.
(e) Government Accountability Office Report.--Not later than 180
days after the date of the enactment of this Act, the Comptroller
General of the United States shall submit to the appropriate committees
of Congress a report that includes the following:
(1) Information related to any regulation issued by, or
Federal program established within, a Federal department or
agency relating to utilizing artificial intelligence, including
whether there is any duplication of such regulation or program
across such departments or agencies.
(2) Information related to any efforts between such
departments or agencies to coordinate, in a consistent manner,
standards and policies relating to utilization of artificial
intelligence.
(3) Recommendations with respect to the following:
(A) Restructuring or eliminating any such
duplication, as the case may be.
(B) Improving any such efforts.
(C) How the Department approaches national and
international priorities relating to artificial
intelligence and innovation.
(D) The functions of the Department.
(E) The leadership structure of the Department,
including with respect to the Secretary and any under
secretaries of the Department, as the case may be.
(F) The organizational structure of the Department.
(G) Any funding, resource, and staffing needs of
the Department.
(H) Legislative actions to carry out the following:
(i) Update relevant Federal statutes to
carry out the following:
(I) Include references to the
Department.
(II) Establish consumer, workforce,
and privacy protections, safety
requirements, and regulations,
including protections, requirements and
regulations related to deepfakes or
misinformation.
(ii) Establish safeguards relating to the
utilization of artificial intelligence by such
departments or agencies, including with respect
to data privacy and cybersecurity.
(iii) Establish mechanisms for reporting
incidents of cybersecurity risks and breach
prevention relating to such utilization.
(4) An assessment of relevant Federal statutes and
executive orders related to the regulation of artificial
intelligence.
(f) Artificial Intelligence.--The terms ``artificial intelligence''
has the meaning given that term in section 238(g) of the John S. McCain
National Defense Authorization Act for Fiscal Year 2019 (Public Law
115-232; 10 U.S.C. note prec. 4061).
