 liability where a controlled substance is a substantial factor in the 
               death or bodily injury of another person.

  Mrs. Moody introduced the following bill; which was read twice and 
               referred to the Committee on the Judiciary

                                 A BILL

 
    To amend the Controlled Substances Act to provide for criminal 
 liability where a controlled substance is a substantial factor in the 
               death or bodily injury of another person.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Prosecuting Poison Pill Dealers 
Act''.

SEC. 2. SUBSTANTIAL FACTOR.

    Section 102 of the Controlled Substances Act (21 U.S.C. 802) is 
amended by adding at the end the following:
            ``(61)(A) The term `results', with respect to the 
        relationship between the use of a substance and death or 
        serious bodily injury, means the use of the substance is a 
        substantial factor in causing such death or serious bodily 
        injury.
            ``(B) For purposes of subparagraph (A), the term 
        `substantial factor' means the use of the substance 
        substantially contributes to the death or serious bodily 
        injury, regardless of whether any other substance used also 
        substantially contributes to the death or serious bodily 
        injury.''.
