RES. 124 Directing the President pursuant to section 5(c) of the War Powers Resolution to remove United States Armed Forces from hostilities against the Houthis in Yemen that have not been authorized by Congress. _______________________________________________________________________ IN THE HOUSE OF REPRESENTATIVES October 9, 2026 Mr. Khanna (for himself and Mr. Massie) submitted the following concurrent resolution; which was referred to the Committee on Foreign Affairs _______________________________________________________________________ CONCURRENT RESOLUTION Directing the President pursuant to section 5(c) of the War Powers Resolution to remove United States Armed Forces from hostilities against the Houthis in Yemen that have not been authorized by Congress. Resolved by the House of Representatives (the Senate concurring), SECTION 1. REMOVAL OF UNITED STATES ARMED FORCES FROM HOSTILITIES AGAINST THE HOUTHIS IN THE REPUBLIC OF YEMEN THAT HAVE NOT BEEN AUTHORIZED BY CONGRESS. (a) Findings.--Congress finds the following: (1) Congress has the sole power to declare war under article I, section 8 of the Constitution. (2) Congress has not declared war with respect to, or provided any specific statutory authorization for the introduction of United States Armed Forces into hostilities against the Houthis in the Republic of Yemen, including direct United States airstrikes against Yemen's Houthis as well as United States intelligence sharing, targeting support, midair refueling, and other operational participation in Saudi-led airstrikes against Yemen's Houthis. (3) The United States Government conducted unauthorized airstrikes on Houthi targets in Yemen in 2025 and has reportedly considered renewed United States airstrikes against the Houthis in Yemen, while the United States is providing aerial refueling for Saudi warplanes and has expanded intelligence and targeting support for Saudi airstrikes against the Houthis in Yemen in a newly established joint forces command in Saudi Arabia in which more than 200 United States troops have been introduced. (4) The conflict against the Houthis in Yemen constitutes unauthorized hostilities and section 2(c) of the War Powers Resolution (50 U.S.C. 1541(c)) states that the constitutional powers of the President as Commander-in-Chief to introduce United States Armed Forces into hostilities may only be exercised pursuant to a declaration of war, a specific statutory authorization, or a national emergency created by attack upon the United States, its territories or possessions, or its Armed Forces. (5) Section 8(c) of the War Powers Resolution (50 U.S.C. 1547(c)) defines the introduction of United States Armed Forces to include ``the assignment of members of such armed forces to command, coordinate, participate in the movement of, or accompany the regular or irregular military forces of any foreign country or government when such military forces are engaged, or there exists an imminent threat that such forces will become engaged, in hostilities''. (6) No defense agreement between the United States and Saudi Arabia provides specific statutory authorization for the assignment of United States Forces that are engaged in hostilities or imminent hostilities against Yemen's Houthis. (b) Removal of Armed Forces.--Pursuant to section 5(c) of the War Powers Resolution (50 U.S.C. 1544(c)), Congress directs the President to remove United States Armed Forces from hostilities against the Houthis in the Republic of Yemen that have not been authorized by Congress, unless authorized by a declaration of war or a specific authorization for such use of United States Armed Forces has been enacted into law. <all>
