RES. 918 Establishing the Select Committee on Artificial Intelligence. _______________________________________________________________________ IN THE SENATE OF THE UNITED STATES September 29, 2026 Mr. Gallego submitted the following resolution; which was referred to the Committee on Rules and Administration _______________________________________________________________________ RESOLUTION Establishing the Select Committee on Artificial Intelligence. Resolved, SECTION 1. DEFINITIONS. In this resolution: (1) Artificial intelligence.--The term ``artificial intelligence'' has the meaning given that term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (15 U.S.C. 9401). (2) Artificial intelligence system.--The term ``artificial intelligence system'' means any machine-based system that, for explicit or implicit objectives, infers from the input it receives how to generate outputs, including predictions, content, recommendations, or decisions, that can influence physical or virtual environments. (3) Select committee.--The term ``Select Committee'' means the Select Committee on Artificial Intelligence established by section 2. SEC. 2. ESTABLISHMENT. (a) In General.--There is established a select committee of the Senate, to be known as the ``Select Committee on Artificial Intelligence''. (b) Duration.--The Select Committee shall be established during the 120th Congress and shall continue in existence unless otherwise provided by the Senate. SEC. 3. MEMBERSHIP. (a) Composition.--The Select Committee shall be composed of not more than 13 Senators, appointed by the President pro tempore of the Senate. (b) Appointments.--In making recommendations under subsection (a), the President pro tempore of the Senate shall consider the qualifications, experience, and expertise of Senators with respect to artificial intelligence and matters within the jurisdiction of the Select Committee. (c) Vacancies.--Any vacancy in the membership of the Select Committee-- (1) shall not affect the powers of the Select Committee; and (2) shall be filled in the same manner as the original appointment. (d) Leadership.-- (1) Chairperson.--The majority leader of the Senate shall designate a member of the Select Committee from the majority party to serve as Chairperson of the Select Committee. (2) Ranking minority member.--The minority leader of the Senate shall designate a member of the Select Committee from the minority party to serve as ranking minority member of the Select Committee. (e) Subcommittees.--The Select Committee may establish such subcommittees as it considers necessary to carry out its responsibilities under this resolution, subject to the Standing Rules of the Senate and the rules of the Select Committee. SEC. 4. PURPOSE AND JURISDICTION. (a) In General.--The Select Committee is authorized and directed-- (1) to conduct investigations and continuing studies of the development, deployment, use, and governance of artificial intelligence, including emerging capabilities and risks across the artificial intelligence ecosystem; (2) to examine the national security, defense, intelligence, cybersecurity, and foreign policy implications of artificial intelligence, including international competition, cooperation, and threats to the security of the United States; (3) to examine the economic and labor implications of artificial intelligence, including effects on employment, job displacement, productivity, workforce development, and the competitiveness of the United States; (4) to examine risks to children and consumers from artificial intelligence, including issues relating to consumer protection, privacy, data security, civil rights, civil liberties, discrimination, and the safety of artificial intelligence products and services; (5) to examine the implications of artificial intelligence for critical infrastructure, energy generation and consumption, water resources, and the environment; (6) to examine the development, procurement, deployment, and use of artificial intelligence by Federal departments and agencies, including existing oversight mechanisms and the adequacy of applicable Federal laws and regulations; (7) to examine the adequacy of existing Federal authorities, standards, testing procedures, and safeguards relating to artificial intelligence, including the identification of potential…

gaps in Federal oversight; (8) to examine international approaches to artificial intelligence governance and opportunities for international cooperation, including the development of common standards, information-sharing mechanisms, and safeguards; (9) to assess and develop appropriate legislative safeguards, recommendations, and proposals pertaining to artificial intelligence; and (10) to examine such other matters relating to artificial intelligence as the Select Committee considers necessary to carry out the purposes set forth in paragraphs (1) through (9). (b) Legislative Jurisdiction.-- (1) In general.--The Select Committee may consider and report to the Senate proposed legislation and other matters relating to artificial intelligence that are referred to the Select Committee in accordance with the Standing Rules of the Senate and applicable orders of the Senate. (2) Rule of construction.--Nothing in this resolution shall be construed to divest any standing committee of the Senate of its existing jurisdiction or to require the exclusive referral of any proposed legislation or other matter to the Select Committee. SEC. 5. POWERS. (a) In General.--For purposes of carrying out this resolution, the Select Committee may-- (1) conduct investigations and inquiries into any matter within its jurisdiction; (2) authorize and issue subpoenas for the attendance and testimony of witnesses and the production of books, records, correspondence, memoranda, papers, documents, electronic files, and other relevant materials; (3) administer oaths to witnesses; (4) sit and act at such times and places within the United States, whether the Senate is in session, has recessed, or has adjourned, as it considers appropriate; (5) hold hearings, take testimony, and receive evidence as it considers necessary; (6) take depositions and other testimony, including through authorized members or employees of the Select Committee, in accordance with applicable Senate rules; (7) procure the services of individual consultants, technical experts, and consulting organizations as necessary to carry out its responsibilities, subject to applicable law and Senate rules; (8) request information, documents, reports, and briefings from Federal departments and agencies concerning matters within its jurisdiction; (9) make recommendations and report legislation and other matters within its jurisdiction, subject to section 4(b); and (10) establish subcommittees and delegate responsibilities to such subcommittees, consistent with this resolution and applicable Senate rules. (b) Subpoenas.--Subpoenas shall be authorized and issued under the signature of the Chairperson of the Select Committee, or by a designee of the Chairperson, and may be served by any person designated by the Chairperson. (c) Rules of Procedure.-- (1) In general.--The Select Committee may adopt such rules of procedure as it considers necessary to carry out its responsibilities, provided that such rules are not inconsistent with the Standing Rules of the Senate or other applicable orders of the Senate. (2) Contents.--The rules adopted under paragraph (1) may address-- (A) the scheduling and conduct of meetings, hearings, and other committee proceedings; (B) quorum requirements for conducting committee business, consistent with applicable Senate rules; (C) procedures for receiving testimony, taking depositions, and considering evidence; (D) procedures for considering and reporting legislation, recommendations, and other matters; (E) the establishment and operation of subcommittees; and (F) such other matters relating to the internal administration and operation of the Select Committee as the Select Committee considers appropriate. SEC. 6. INFORMATION ACCESS AND AGENCY REPORTING. (a) Access to Information.--The Select Committee may request and receive from the President and the heads of Federal departments and agencies information, documents, reports, and briefings relevant to matters within its jurisdiction, consistent with applicable law and Senate rules. (b) Agency Reporting.--The Select Committee may request that the heads of relevant Federal departments and agencies provide periodic reports or briefings concerning-- (1) significant developments in artificial intelligence capabilities, deployment, and emerging risks; (2) the development, procurement, and use of artificial intelligence by Federal departments and agencies; (3) significant artificial intelligence-related threats to national security, cybersecurity, critical infrastructure, or public safety; (4) Federal activities relating to artificial intelligence testing, evaluation, standards, and oversight; and (5) such other matters relating to artificial intelligence as the Select Committee considers appropriate. (c) Access by Members.--Each member of the Select Committee shall have access to information, records, reports, and other materials obtained by the Select Committee in the course of carrying out its responsibilities, subject to applicable law, Senate rules, and requirements governing the protection of classified or otherwise sensitive information. (d) Coordination With Other Committees.--The Select Committee may consult and coordinate with standing and select committees of the Senate-- (1) on matters relating to artificial intelligence that fall within their respective jurisdictions, including through joint hearings, briefings, and the exchange of information, consistent with applicable Senate rules; and (2) in obtaining and reviewing information relevant to matters within their respective jurisdictions, consistent with applicable Senate rules and requirements governing the protection of classified or otherwise sensitive information. SEC. 7. CLASSIFIED INFORMATION AND SECURITY. (a) In General.--The Select Committee shall establish procedures for the receipt, handling, storage, use, and disclosure of classified information and other sensitive information obtained in carrying out its responsibilities, consistent with applicable law and Senate rules. (b) Personnel Requirements.--An employee, consultant, contractor, or detailed employee of the Select Committee may be granted access to classified information only if the individual-- (1) possesses any security clearance required for access to such information; (2) has executed any confidentiality agreement or acknowledgment required under applicable Senate rules and security procedures; and (3) complies with applicable requirements governing the protection of classified information. (c) Protection of Information.--Nothing in this resolution shall be construed to authorize the public disclosure of classified information or other information protected from disclosure by applicable law or Senate rules. SEC. 8. STAFF AND PERSONNEL. (a) In General.--The Select Committee may employ and compensate such professional, administrative, technical, and other personnel as the Select Committee considers necessary to carry out its responsibilities, subject to applicable law and Senate rules. (b) Staff Resources.-- (1) Equal access.--The Chairperson and ranking member of the Select Committee shall have equal access to staffing resources and technical expertise necessary to carry out the responsibilities of the Select Committee. (2) Distribution of funding.--Of the funds made available to the Select Committee for personnel, 50 percent shall be under the control of the Chairperson and 50 percent shall be under the control of the ranking member of the Select Committee. (3) Shared administrative and technical personnel.--The Chairperson and ranking member of the Select Committee shall jointly determine the allocation of shared administrative and technical personnel, consistent with the equal allocation of personnel resources under paragraph (2). (c) Technical Expertise.--The Select Committee may employ or retain individuals with expertise in artificial intelligence, computer science, cybersecurity, national security, economics, labor, consumer protection, privacy, and other matters relevant to its jurisdiction. (d) Detailed Personnel.-- (1) In general.--With the prior consent of the Federal department or agency concerned and the Committee on Rules and Administration of the Senate, the Select Committee may use, on a reimbursable or nonreimbursable basis, the services of personnel of such department or agency. (2) Sources of personnel.--Personnel detailed under paragraph (1) may include personnel from Federal departments and agencies with expertise relevant to the responsibilities of the Select Committee. (3) Supervision and security.--Personnel detailed under this subsection shall be subject to the supervision of the Select Committee and applicable Senate requirements concerning confidentiality, conflicts of interest, and access to classified or otherwise sensitive information. SEC. 9. FUNDING AND EXPENDITURES. (a) Authorization.--For purposes of carrying out this resolution, the Select Committee may make expenditures from the contingent fund of the Senate, subject to applicable law, Senate rules, and the approval of the Committee on Rules and Administration of the Senate. (b) Permissible Expenditures.--Expenditures authorized under subsection (a) may include-- (1) compensation of personnel employed by the Select Committee; (2) procurement of the services of consultants, technical experts, and consulting organizations; (3) expenses associated with hearings, investigations, depositions, and other committee proceedings; (4) acquisition of equipment, technology, and other resources necessary to carry out the responsibilities of the Select Committee; and (5) such other administrative and operational expenses as are necessary to carry out this resolution. (c) Budget.--The Chairperson and ranking member of the Select Committee shall jointly develop and submit the budget of the Select Committee for consideration and approval in accordance with applicable Senate rules and procedures. (d) Allocation of Resources.--Funds made available to the Select Committee for personnel shall be allocated in accordance with section 7(b). SEC. 10. REPORTS AND RECOMMENDATIONS. (a) In General.--The Select Committee may submit to the Senate reports, findings, and recommendations concerning matters within its jurisdiction, including recommendations for legislative or administrative action. (b) Legislative Proposals.--The Select Committee may develop and submit legislative proposals relating to artificial intelligence and may consider and report legislation referred to it in accordance with section 4(b). (c) Coordination.--The Select Committee may transmit its findings and recommendations to standing and select committees of the Senate with jurisdiction over the matters addressed in such findings and recommendations. (d) Protection of Information.--Any report submitted under this section shall be prepared and made available in a manner consistent with applicable requirements governing the protection of classified or otherwise sensitive information. <all>
