RES. 938 To honor the Americans killed by Hamas terrorists and their affiliates on and after October 7, 2023, to reaffirm the commitment of the United States to seek legal justice on behalf of their families, and for other purposes. _______________________________________________________________________ IN THE SENATE OF THE UNITED STATES September 30, 2026 Mr. Scott of Florida (for himself and Ms. Rosen) submitted the following resolution; which was considered and agreed to _______________________________________________________________________ RESOLUTION To honor the Americans killed by Hamas terrorists and their affiliates on and after October 7, 2023, to reaffirm the commitment of the United States to seek legal justice on behalf of their families, and for other purposes. Whereas, beginning on October 7, 2023, Hamas terrorists and their affiliates launched a coordinated and unprovoked attack against the State of Israel, murdering more than 1,200 people, wounding thousands more, and taking 251 hostages, including 12 Americans, into the Gaza Strip; Whereas the Department of State has confirmed that at least 46 Americans were killed by Hamas and its affiliates in the attacks of October 7, 2023, one of the largest losses of American lives in a single day since September 11, 2001; Whereas the 46 Americans who were killed on October 7, 2023, that have been publicly reported as of the date of adoption of this resolution include the following victims: (1) Laor Abramov, 20. (40) Aryeh Ziering, 27; Whereas the remains of several Americans killed on October 7, 2023, as well as the remains of another hostage killed in captivity, were held in Gaza, in some cases for more than 760 days; Whereas seven Americans were released alive following diplomatic efforts in which the United States Government played a significant role across successive administrations, including Judith Raanan and her daughter Natalie Raanan, Avigail (Abigail) Idan, then four years old, Liat Beinin Atzili, Keith Siegel, Sagui Dekel-Chen, and Edan Alexander, the last living American hostage released May 12, 2025, after 584 days in captivity; Whereas the safe return of these American hostages demonstrates what sustained, high-level engagement by the United States Government can achieve on behalf of Americans, and underscores the responsibility of the United States to continue to use every available diplomatic and legal tool on behalf of American hostages and their families; Whereas the families of the American victims of October 7, 2023, continue to seek acknowledgment, accountability, and legal justice on behalf of their murdered loved ones, and have pursued that justice, including through litigation in the courts of the…

United States against those alleged to have provided material and financial support to Hamas and its affiliates; and Whereas United States law provides American victims of international terrorism, and their families, with avenues to seek legal accountability in United States courts from those responsible for acts of international terrorism, and, where authorized by law, those who provide material support for such acts: Now, therefore, be it Resolved, That the Senate-- (1) honors and mourns Americans who were murdered by Hamas terrorists and their affiliates on and after October 7, 2023; (2) expresses its deepest condolences to the hostages, as well as the families and loved ones of American victims; (3) condemns Hamas and its affiliates for the murder of 1,200 people and the taking of 251 hostages on October 7, 2023; (4) commends the sustained diplomatic efforts of the United States Government, across successive administrations, in helping to secure the release of 12 living and fallen Americans taken hostage by Hamas and its affiliates on October 7, 2023, and urges the United States Government to continue to use every available diplomatic and legal tool on behalf of Americans held hostage, alive or deceased, anywhere in the world; (5) supports continued engagement from the United States Government with the victims of October 7, 2023, as well as with their families; and (6) directs the Secretary of the Senate to transmit an enrolled copy of this resolution to the Secretary of State, for transmission to the families of the American victims murdered by Hamas and its affiliates on and after October 7, 2023, and to the Americans taken hostage and subsequently released and their families. <all>
