Mr. KAINE submitted an amendment intended to be proposed by him to the concurrent resolution S. Con. Res. 33, setting forth the congressional budget for the United States Government for fiscal year 2026 and setting forth the appropriate budgetary levels for fiscal years 2027 through 2035; which was ordered to lie on the table; as follows: At the appropriate place in title IV, add the following: SEC. 4___. POINT OF ORDER AGAINST INCREASING THE DEFICIT THROUGH RECONCILIATION MULTIPLE TIMES DURING A SINGLE CONGRESS. (a) Point of Order.--It shall not be in order in the Senate to consider a reconciliation bill pursuant to section 310 of the Congressional Budget and Impoundment Control Act of 1974 (2 U.S.C. 644), or an amendment to, conference report on, or amendment between the Houses in relation to such a bill, that would cause or increase a deficit or reduce a surplus in any year if-- (1) the Congressional Budget Office estimated that a prior reconciliation bill considered during the same Congress pursuant to section 310 of the Congressional Budget and Impoundment Control Act of 1974 (2 U.S.C. 644) (as amended, if amended) would cause or increase a deficit or reduce a surplus in any year; and (2) that reconciliation bill was enacted into law. (b) Waiver and Appeal.--Subsection (a) may be waived or suspended in the Senate only by an affirmative vote of three- fifths of the Members, duly chosen and sworn. An affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on a point of order raised under subsection (a). (c) Determination of Budget Levels.--For purposes of this section, the levels of net deficit increases and net surplus reduction shall be determined on the basis of estimates prepared by the Congressional Budget Office that are provided by the Committee on the Budget of the Senate. ______
