Ms. CORTEZ MASTO submitted an amendment intended to be proposed by her to the bill S. 4784, to authorize appropriations for fiscal year 2027 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows: At the end of subtitle G of title X, add the following: SEC. 1___. PROHIBITION ON FOREIGN ENTITIES ENTERING INTO EVENT CONTRACTS INVOLVING NATIONAL DEFENSE INFORMATION. Section 5c of the Commodity Exchange Act (7 U.S.C. 7a-2) is amended by inserting after subsection (c) the following: ``(d) Prohibition on Foreign Entities Entering Into Event Contracts Involving National Defense Information.-- ``(1) Definitions.--In this subsection: ``(A) Covered entity.--The term `covered entity' means an entity-- ``(i) that makes available for clearing or trading any covered event contract; and ``(ii) a majority of the ownership interest of which is held by one or more non-United States persons. ``(B) Covered event contract.--The term `covered event contract' means an agreement, contract, transaction, or swap in an excluded commodity that is based upon an occurrence, extent of an occurrence, or contingency (other than a change in the price, rate, value, or levels of a commodity described in section 1a(19)(i)) involving national defense information described in section 793 of title 18, United States Code. ``(2) Requirement.--To be designated as a contract market or registered as a swap execution facility under this Act, a covered entity shall take such actions as are necessary to ensure that the covered entity does not enter into or offer to enter into any covered event contract with a United States person. ``(3) Suspension or revocation of registration.--A covered entity designated or registered as a contract market or swap execution facility under this Act that knowingly violates paragraph (2) shall be subject to suspension of registration or revocation as a registered entity in accordance with section 5e.''. ______
