Mrs. HYDE-SMITH submitted an amendment intended to be proposed by her to the bill S. 4784, to authorize appropriations for fiscal year 2027 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows: At the appropriate place in title X, insert the following: SEC. ___. PROTECTION OF LAWFULLY OWNED PERSONAL PROPERTY DURING EXECUTION OF MILITARY ORDERS. (a) Protection.-- (1) In general.--Notwithstanding any other provision of Federal, State, or local law, in any case in which a servicemember receives military orders for a permanent change of station or to deploy with a military unit, or as an individual in support of a military operation, the servicemember and any dependent of the servicemember shall not, during the period specified in paragraph (2), be prohibited from-- (A) the transportation, possession, ownership, or use of any firearm (as defined in section 921(a) of title 18, United States Code), and any part, component, accessory, attachment, magazine, or ammunition feeding device designed and intended for use in or on such firearm, other than a firearm silencer (as defined in section 921(a) of title 18, United States Code), that was lawfully acquired and possessed by the servicemember or dependent-- (i) before the issuance of such orders; and (ii) under Federal law and the laws of the State in which such item was purchased or otherwise acquired; or (B) the transportation, possession, or ownership of ammunition that was lawfully acquired and possessed by the servicemember or dependent-- (i) before the issuance of such orders; and (ii) under Federal law and the laws of the State in which such ammunition was purchased or otherwise acquired. (2) Period specified.--The period specified in this paragraph with respect to military orders is the period beginning on the date of the issuance of the military orders and ending on the date that is 180 days after the date on which the military orders are completed or concluded. (b) Registration and Fees.--In a case described in paragraph (1) of subsection (a), the servicemember and any dependent of the servicemember shall not be required by any State to register, or provide notice or pay any fee with respect to the importation, possession, or ownership of, any item described in such paragraph during the period specified in paragraph (2) of such subsection. (c) Rules of Construction.--Nothing in this section shall be construed-- (1) to authorize the commercial sale, transfer, or other disposition within the State of assignment of any firearm, firearm component, magazine, ammunition feeding device, or ammunition in violation of the laws of that State; (2) to permit the possession, transportation, storage, or use of any such item in violation of applicable Federal law, including regulation of the Department of Defense and regulations governing conduct on military installations; (3) to supersede any State or local law restricting the discharge or use of certain types of ammunition for fire- safety or similar public-safety purposes; and (4) to authorize the carrying of a concealed firearm or supersede State laws governing concealed carry permits. (d) Sale and Transfer.--A servicemember and any dependent of a servicemember seeking to sell or transfer any item described in subsection (a)(1) shall do so only through a lawful transfer-- (1) to a recipient or a manufacturer, dealer, or importer licensed under chapter 44 of title 18, United States Code, located in a jurisdiction in which such item is legal to possess; and [[Page S3753]] (2) made in accordance with applicable Federal and State law. (e) Definitions of Military Orders and Permanent Change of Station.--In this section: (1) The terms ``dependent'', ``servicemember'', and ``State'' have the meanings given such terms in section 2 of the Servicemembers Civil Relief Act (50 U.S.C. 3902). (2) The terms ``military orders'' and ``permanent change of station'' have the meanings given such terms in section 305(i) of the Servicemembers Civil Relief Act (50 U.S.C. 3955(i)). ______
