Mr. KAINE submitted an amendment intended to be proposed by him to the bill S. 4784, to authorize appropriations for fiscal year 2027 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows: At the appropriate place in title X, insert the following: [[Page S3304]] SEC. ___. COUNTERING ILLICIT DRUG TRAFFICKING. (a) Prohibition on Use of Funds.--None of the funds authorized to be appropriated or otherwise made available by this Act may be used by the Department of Defense to fund military operations or activities against persons, facilities, vehicles, or watercraft alleged to be affiliated with illicit drug trafficking without evidence of narcotics on such person, facility, vehicle, or watercraft. (b) Notification Requirement.--Any notification submitted under section 130f of title 10, United States Code, associated with a military operation or activity described in subsection (a) shall include a description of the intelligence collected to determine the evidence of the presence of narcotics. (c) Rule of Construction.--Nothing in this section may be construed to authorize the use of military force against persons, facilities, vehicles or watercraft alleged to be affiliated with illicit drug trafficking except pursuant to a congressional authorization consistent with section 2(c) of the War Powers Resolution (50 U.S.C. 1541(c)). ______
