Mr. SCHIFF submitted an amendment intended to be proposed to amendment SA 5453 proposed by Mr. Thune (for Mr. Graham) to the bill S. 2, to provide for reconciliation pursuant to title II of S. Con. Res. 33.; which was ordered to lie on the table; as follows: At the appropriate place, insert the following: SEC. ___. PROHIBITION ON AVAILABILITY OF FUNDS FOR CERTAIN INTELLIGENCE ELEMENTS OF THE DEPARTMENT OF HOMELAND SECURITY TO CARRY OUT UNLAWFUL MONITORING OF UNITED STATES PERSONS. None of the funds appropriated by this Act may be used by the Office of Intelligence of U.S. Immigration and Customs Enforcement, the Office of Intelligence of U.S. Customs and Border Protection, or any other intelligence element within the Department of Homeland Security to conduct any intelligence activity, including the collection, analysis, or dissemination of any intelligence information, for the sole purpose of monitoring activities of United States persons protected by the First Amendment of the Constitution of the United States or the lawful exercise of other rights secured by the Constitution or other laws of the United States. ______
